Model Contract: What You Need to Know — Rights, Commission & Termination

You’ve been handed a contract by a model agency — now what? Before you sign, you should know the most important clauses. CM Models explains what matters.

What’s in a Model Contract?

A professional model contract governs the relationship between model and agency. The most important points:

  • Exclusivity: do you work only with this agency, or with others too?
  • Commission: what share does the agency take from your fee? (Typical: 15–25%)
  • Term: how long does the contract run? Are there notice periods?
  • The model’s obligations: availability, keeping stable measurements, reporting duties
  • Image rights: who’s allowed to use your photos for marketing?

Exclusivity: Advantage or Trap?

Exclusive contracts mean: you only work with one agency. That can be good (full support, booking guarantee) — or bad (few bookings, yet still locked in).

An exclusive contract is only as good as the agency behind it. Ask yourself: how many bookings do they make per month?

  • Exclusive: only one agency, but full support and priority
  • Non-exclusive: multiple agencies possible — but none feels fully responsible
  • Mother-agency model: one main agency, others as secondary representatives — the most common middle ground

Commission: What’s Fair?

Agency commission is calculated on the gross fee. Typical rates:

  • 15%: favorable, common at smaller agencies
  • 20%: standard in Germany
  • 25%+: only justified with very active marketing and a large network

Be careful: agencies that also take extra money from the client (double-dipping) are not trustworthy.

Red Flags in a Contract

  • Upfront payments for a sedcard or for being signed — legitimate agencies don’t ask for this
  • Terms of more than 2 years with no exit clause
  • Vague image-rights clauses — who’s allowed to use your face, and for how long?
  • No exact commission rates — just “usual commission”
  • No option to terminate the contract in case of inactivity

Terminating the Contract — What’s Possible?

Legitimate agencies have clear notice periods — usually 3 months to the end of the year, or in case of inactivity. Read the clause carefully: some contracts renew automatically.
