The buyout explained simply!
The buyout, also known as usage rights, is an additional fee that a model receives if the images they provide are used beyond the agreed period or publication location.
The amount of this buyout fee is determined when the model is commissioned and depends on the range, use and duration. It makes a difference where the images are published.
The longer the period of use, the higher the buyout. This ensures that the model benefits from the distribution of her images. The booker of a model agency monitors these image rights and takes care of the payment of the fees earned. Without working with a model agency, there is a risk that the model will not be paid correctly. The greater the reach of the media, the higher the buyout payout for the model, and buyouts can also be purchased again for further years and countries once they have ended.
Exclusivity of buyouts
The exclusive buyout is a special form of buyout. There is an exclusive buyout license that regulates the process of an exclusive sale. The customer acquires an extended range of rights through an exclusive buyout.
This agreement restricts the use of the images or material solely to the agreed client and excludes other potential uses by other clients or competitors.
Such a buyout often grants the client the right to use the images or material without time or space restrictions. It can also take various forms depending on the negotiations and agreements between the model, the agency and the client. The financial terms and remuneration of the model are carefully defined in these exclusive buyout agreements, as the model can usually demand a higher remuneration due to the exclusivity of use.
In order to be able to calculate the exact surcharge incurred, there is a so-called Velma table that lists all the different buyouts (billboards, posters, Internet, film, etc.) in a structured manner. It serves as a guide for all parties involved.
